SUMMARY:Towards a Theory of Arbitration: A Decentering Approach to Globaliz
 ation
DESCRIPTION:\n	A workshop co-sponsored by the Harvard-Yenching Institute an
 d the Faculty of Law\, Chinese University of Hong Kong.\n\n\n	\n		Arbitrat
 ion has evolved from a domestic phenomenon to play an increasingly importa
 nt role internationally in the context of commercial\, trade and investmen
 t disputes. The proliferation of these ‘cosmopolitan institutions’ suc
 h as international arbitral tribunals pushes global legal scholars to find
  new definitions and methodologies to approach globalization\, to move awa
 y from the exclusive standpoint of legal norms to the standpoint of the ac
 tors themselves and their legal practices. It may offer a ‘decentering
 ’ approach to the study of globalization.\n	\n		How precisely arbitratio
 n as a field should be conceptualized? Has arbitration become part of a tr
 ansnational non-state regulatory regime — a new ‘lex mercatoria’ out
 side the political structures of national States? What is the origin of ar
 bitration? What is the value of arbitration? What is the legitimacy of arb
 itration?\n	\n		This workshop brings a group of distinguished scholars fro
 m different jurisdictions and disciplines to explore the various dimension
 s of arbitration from philosophical\, historical\, cultural and economic p
 erspectives. It intends to provide a space for debate\, engagement and ex
 ploration of ideas\, breaking through conventional sub-disciplinary bounda
 ries — legal history\, comparative law\, jurisprudence\, legal anthropol
 ogists\, law and economics and other areas of substantive interest.\n	\n
